ASİSTA — Kullanım Koşulları

Bu koşullar, ASISTA TEKNOLOJİ YAZILIM TİCARET LİMİTED ŞİRKETİ ("Şirket") tarafından sunulan ASİSTA mobil uygulamasının ("Uygulama") kullanımını düzenler. Uygulamayı kullanarak bu koşulları kabul etmiş olursunuz.

1. Hizmet

ASİSTA; hatırlatıcı, not, yapılacaklar listesi ve hedef takibi sunan, yapay zekâ destekli bir kişisel asistan uygulamasıdır. Kullanım için telefon numarası ile hesap oluşturmanız gerekir. Hesabınızın ve telefonunuzun güvenliğinden siz sorumlusunuz.

2. Abonelik ve ödeme

• ASİSTA+ aboneliği aylık veya yıllık olarak sunulur ve dönem sonunda otomatik yenilenir.
• Ödeme, satın alma onaylandığında App Store veya Google Play hesabınızdan tahsil edilir.
• Abonelik, mevcut dönemin bitiminden en az 24 saat önce iptal edilmediği takdirde otomatik olarak yenilenir ve yenileme ücreti dönem bitiminden önceki 24 saat içinde tahsil edilir.
• Aboneliğinizi istediğiniz zaman mağaza hesabınızın ayarlarından yönetebilir ve iptal edebilirsiniz. İptal, içinde bulunduğunuz dönemin sonunda geçerli olur; kullanılmakta olan dönem için iade yapılmaz.
• Güncel fiyatlar satın alma ekranında ve mağaza sayfasında gösterilir; fiyatlar ülkeye göre değişir ve değiştirilebilir. Fiyat değişiklikleri yalnızca yeni dönemler için geçerlidir.
• İade talepleri satın alma işlemini gerçekleştiren mağaza (Apple veya Google) tarafından kendi politikaları çerçevesinde değerlendirilir.

4. Hatırlatıcıların güvenilirliği

Uygulama, hatırlatıcılarınızı zamanında iletmek için elinden geleni yapar; ancak bildirimlerin ve arama hatırlatıcılarının ulaşması işletim sistemi ayarlarınıza, pil optimizasyonuna, ağ bağlantınıza ve Apple/Google'ın bildirim altyapısına bağlıdır. Hayati önem taşıyan durumlar için Uygulamayı tek hatırlatma kaynağı olarak kullanmayınız.

5. Kabul edilebilir kullanım

Uygulamayı şu amaçlarla kullanamazsınız:

• Yürürlükteki mevzuata aykırı herhangi bir faaliyet
• Başkalarını taciz etmek, tehdit etmek veya istenmeyen içerik göndermek
• Başkasının kimliğine bürünmek
• Uygulamanın kaynak koduna erişmeye, tersine mühendislik yapmaya veya güvenlik önlemlerini aşmaya çalışmak
• Hizmete otomatik araçlarla aşırı yük bindirmek

Bu kurallara aykırı kullanım halinde hesabınızı askıya alabilir veya kapatabiliriz.

6. İçeriğiniz

Uygulamaya girdiğiniz tüm içerik size aittir. Şirket, bu içeriği yalnızca size hizmet sunmak amacıyla işler; sahipliği devralmaz, reklam amacıyla kullanmaz ve üçüncü taraflara satmaz. Ayrıntılar için Gizlilik Politikası'na bakınız.

7. Hizmetin sürekliliği

Uygulama "olduğu gibi" sunulur. Bakım, güncelleme veya teknik zorunluluklar nedeniyle hizmete ara verilebilir veya özellikler değiştirilebilir. Ücretli bir özelliğin kalıcı olarak kaldırılması halinde, kalan abonelik süreniz için makul bir çözüm sunulur.

8. Sorumluluğun sınırı

Yürürlükteki hukukun izin verdiği azami ölçüde Şirket; dolaylı zararlardan, kâr kaybından, veri kaybından veya kaçırılan hatırlatıcılardan doğan zararlardan sorumlu tutulamaz. Şirketin toplam sorumluluğu, talebin doğduğu tarihten önceki 12 ay içinde Uygulama için ödediğiniz tutarla sınırlıdır. Bu madde, tüketici mevzuatından doğan haklarınızı ortadan kaldırmaz.

9. Hesabın kapatılması

Hesabınızı dilediğiniz zaman uygulama içinden veya hesap silme sayfası üzerinden kalıcı olarak silebilirsiniz.

10. Uygulanacak hukuk

Bu koşullara Türkiye Cumhuriyeti hukuku uygulanır. Uyuşmazlıklarda Hatay mahkemeleri ve icra daireleri yetkilidir. Tüketici sıfatını haiz kullanıcılar, kendi yerleşim yerlerindeki tüketici hakem heyetlerine ve mahkemelerine başvurma hakkını saklı tutar.

ASİSTA — Terms of Use

These terms govern your use of the ASİSTA mobile application ("the App") provided by ASISTA TEKNOLOJI YAZILIM TICARET LIMITED SIRKETI ("the Company"). By using the App you accept these terms.

1. The service

ASİSTA is an AI-assisted personal assistant offering reminders, notes, to-do lists and goal tracking. Using it requires creating an account with your phone number. You are responsible for the security of your account and device.

2. Subscription and payment

• ASİSTA+ is offered as a monthly or yearly subscription and renews automatically at the end of each period.
• Payment is charged to your App Store or Google Play account upon confirmation of purchase.
• Your subscription renews automatically unless cancelled at least 24 hours before the end of the current period; the renewal charge is taken within the 24 hours before the period ends.
• You can manage and cancel your subscription at any time in your store account settings. Cancellation takes effect at the end of the current period; no refund is given for the period already in progress.
• Current prices are shown on the purchase screen and on the store listing. Prices vary by country and may change; price changes apply only to future periods.
• Refund requests are handled by the store that processed the purchase (Apple or Google) under their own policies.

4. Reliability of reminders

The App makes every effort to deliver your reminders on time, but delivery of notifications and call reminders depends on your operating system settings, battery optimisation, network connection and Apple's or Google's notification infrastructure. Do not rely on the App as your only reminder for life-critical matters.

5. Acceptable use

You may not use the App to: break any applicable law; harass, threaten or send unwanted content to others; impersonate another person; attempt to access the source code, reverse engineer the App or bypass its security measures; or place excessive automated load on the service. We may suspend or close accounts that breach these rules.

6. Your content

All content you enter belongs to you. The Company processes it only to provide the service to you; it does not take ownership, use it for advertising, or sell it to third parties. See the Privacy Policy for details.

7. Availability

The App is provided "as is". Service may be interrupted or features changed for maintenance, updates or technical reasons. If a paid feature is permanently removed, we will offer a reasonable remedy for the remainder of your subscription.

8. Limitation of liability

To the maximum extent permitted by law, the Company is not liable for indirect damages, loss of profit, loss of data, or damages arising from missed reminders. The Company's total liability is limited to the amount you paid for the App in the 12 months preceding the claim. This clause does not remove rights you have under consumer protection law.

9. Closing your account

You may permanently delete your account at any time from inside the App or via our account deletion page.

10. Governing law

These terms are governed by the laws of the Republic of Türkiye, with the courts of Hatay having jurisdiction. Users who qualify as consumers retain the right to bring proceedings before the consumer arbitration committees and courts of their own place of residence.
